The Working Group Sea Transport (WG Sea) continues to proactively address the need to ensure a fair and level playing field in maritime logistics. In recent months, FIATA welcomed the landmark decision of the US Federal Maritime Commission (FMC) with its Final Rule on Demurrage and Detention, which came after an extensive six-year investigatory process. Though the FMC decision applies solely to the United States, the analysis and findings of the FMC apply worldwide. Demurrage and detention charges are, after all, a global issue, and therefore the decision has the potential to have important implications in other jurisdictions. Ultimately, the goal is to ensure that they are reasonable and in line with their purpose, which is to incentivize cargo and equipment velocity.
Harnessing the expertise of WG Sea, FIATA will therefore be launching a dedicated FMC toolkit this autumn, geared towards empowering its members to promote the decision within their national contexts to regulators, policymakers and industry. The toolkit will include a press release to be adapted and distributed to local media, presentation slides, and a detailed analysis of the FMC Final Rule from which FIATA members can extract and use the parts of greatest relevance to their national environments. In addition, the WG Sea Chair, Jens Roemer, will be on hand to present and exchange on this topic at FIATA regional meetings to promote and foster understanding of this topic for the benefit of the industry.
As the global voice of freight forwarding logistics, the launch of this FMC toolkit is a crucial step in FIATA’s commitment to play a leading role on the worldwide issue of demurrage and detention. It is hoped that the FMC Final Rule will have a knock-on effect to end unreasonable and unjust practices, and promote transparent and reasonable demurrage and detention practices that improve supply chain fluidity.
